Welcome to Phytu, a DBA of Humpathy LLC! These Terms of Service ("Terms") govern your use of our platform, services, and marketplace located at https://www.phytu.com ("Phytu", "we", "our", or "us"). By accessing or using Phytu, you agree to be bound by these Terms.

Please read them carefully.

Who Can Use Phytu You must:

Be at least 18 years old (or 13+ with parental consent where legally allowed).

Have the legal capacity to enter into contracts.

Provide accurate and complete information during registration.

Account Responsibilities You're responsible for:

Maintaining the confidentiality of your account.

All activity under your account.

Ensuring your listings, communications, and transactions comply with these Terms and all applicable laws.

We reserve the right to suspend or terminate accounts that violate our policies.

Marketplace Overview Phytu is a multi-vendor marketplace for plants, fungi, small garden & farm beneficial animals — users can list, buy, and sell products. We do not guarantee items unless stated otherwise.

Buyers contract directly with sellers.

Phytu is not liable for disputes, quality issues, or shipment delays, though we may assist in resolving conflicts.

Listings and Prohibited Items Sellers must ensure that their listings:

Accurately describe the item.

Do not violate any local, state, national, or international laws.

Do not infringe on intellectual property.

Prohibited items include (but are not limited to):

Illegal or stolen goods

Animals that are not meant to live outdoors, especially dogs and cats

Dead animals and taxidermies

Fees and Payments Phytu may charge listing fees, transaction fees, or commissions.

Payments are processed securely via third-party payment providers (e.g., Stripe).

Sellers are responsible for any applicable taxes.

Returns, Refunds & Disputes Each seller may have their own return policy. Buyers should review individual policies before purchase.

Phytu may intervene in cases of:

Fraud

Non-delivery

Abuse of the platform

User Conduct You agree not to:

Use Phytu for fraudulent or illegal activities

Harass, abuse, or harm others

Upload harmful code or disrupt the platform

Collect or store personal information of other users without consent

Intellectual Property All platform content (excluding user-generated content) is owned by Phytu or its licensors.

By submitting content (e.g. listings, photos, reviews), you grant Phytu a worldwide, royalty-free license to use, display, and distribute your content in connection with the platform.

Termination We may suspend or terminate your access to Phytu at any time, with or without notice, for any violation of these Terms or misuse of the platform.
Limitation of Liability Phytu is not responsible for:

The conduct or content of any user

Any loss, damage, or injury resulting from transactions or use of the platform

Interruption or errors in service

To the fullest extent permitted by law, Phytu’s liability is limited to the amount you paid us (if any) in the past 12 months.

Changes to Terms We may update these Terms from time to time. Continued use of Phytu after changes means you accept the revised Terms.
Governing Law These Terms and any dispute arising from your use of the Phytu platform shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.

You agree that any legal action or proceeding related to your use of Phytu shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the jurisdiction of those courts.
